Overview of Transport Activity Classifications
The Saudi Road Transport Law organizes all commercial transport on Saudi roads into clearly defined categories. Article 8 provides the top-level classification, while Articles 9, 10, and 11 break these down into specific activity types. Understanding where your business or service fits is the first step toward legal operation.
Passenger Transport Activities (Article 9)
Passenger transport is one of the most regulated areas of the law. It is divided into the following sub-activities:
- Regular transport — scheduled services operating on fixed routes (e.g., intercity buses)
- Irregular transport — non-scheduled services such as chartered buses or group travel
- Private passenger transport — transport organized for a specific company or institution's employees or members
- Private automobile transport — includes app-based ride services and similar models
- Taxi transport — traditional licensed taxi operations
- Intermediation in passenger transport — platforms or agents that connect passengers with transport providers (relevant to ride-hailing apps)
Expats working in the technology or platform economy should note that operating a digital intermediation service in passenger transport requires its own license, separate from the actual transport operators on the platform.
Freight Transport Activities (Article 10)
Freight operations are similarly categorized:
- Transport of goods for commercial purposes — delivery and logistics businesses operating for profit
- Transport of goods for non-commercial purposes — moving goods without a commercial profit motive (e.g., a company moving its own equipment)
- Intermediation in freight transport — freight brokerage and logistics platform services
Expats running e-commerce, import/export, or supply chain businesses need to identify whether their transport operation is commercial or non-commercial, as different licensing requirements apply.
Vehicle Rental Activities (Article 11)
The law specifically governs rental services for the following vehicle types:
- Bus rental
- Private automobile rental — including short-term and long-term car rental
- Truck rental
- Bike rental
- Intermediation in rental services — platforms that connect customers with rental providers
Expats planning to open a car rental agency or a peer-to-peer vehicle rental platform must ensure they hold the correct license for their specific rental activity. Intermediation services require a separate license from direct rental operators.
Permitted Vehicles Under the Law
Article 3 lists the vehicles that may legally be used for road transport in Saudi Arabia:
- Buses
- Private automobiles
- Taxis
- Trucks
- Bikes
- Tractors, trailers, and semi-trailers
- Any future transport means classified under the law
This open-ended final category means the law is designed to accommodate emerging transport technologies, such as autonomous vehicles or electric cargo carriers, as they are formally classified by the TGA.
Vehicles Exempt from the Law
Article 28 provides a list of vehicle types that fall outside the scope of the Road Transport Law entirely:
- Government vehicles
- Diplomatic and consular mission vehicles
- Emergency and ambulance vehicles
- Hearses
- Cash and valuables transport vehicles
Expats working for diplomatic missions or certain government-contracted roles should verify whether their vehicle use falls within these exemptions.
Why Getting the Classification Right Matters
Operating in the wrong activity category — for example, using a vehicle licensed for private transport to carry commercial freight — is a violation under Article 5. Penalties can include warnings, fines, license suspension, or revocation. The TGA actively inspects operations, and inspectors have broad powers under Article 19 to detect and investigate violations.
Practical Tips for Expats
- Map your business model to the correct activity type before applying for a license
- Do not assume that one license covers multiple activity types — each category may require its own authorization
- Consult the Implementing Regulations or a Saudi-qualified legal adviser for sub-activity requirements
- Check for future regulatory updates — the TGA Board can add new activity categories as the market evolves
