How Violations Are Classified
The Saudi Road Transport Law does not list every possible violation in the main text. Instead, Article 23 directs the President of the TGA to issue a violation classification schedule that maps specific offenses to their corresponding penalties. This schedule takes into account:
- The nature of each violation
- The gravity or severity of the offense
- Aggravating circumstances (factors that make the violation worse)
- Mitigating circumstances (factors that reduce the severity)
For expats, this means penalties are not one-size-fits-all. A first-time, minor procedural breach will be treated very differently from a serious or repeated violation. It is advisable to consult the current violation schedule, available through the TGA, or seek legal advice when facing any enforcement action.
The Full Range of Penalties
Article 22 lists the penalties that can be imposed on anyone who violates the law, its Implementing Regulations, or the terms of their license. These include:
- Warning — the least severe penalty, often accompanied by a grace period to correct the issue
- Financial fine — a monetary penalty scaled to the type and severity of the violation
- License suspension — temporary withdrawal of your right to operate, either fully or partially
- License revocation — permanent cancellation of your license, representing the most severe administrative outcome
- Vehicle impoundment — physical seizure of a vehicle used in violation of the law
Importantly, more than one penalty can be imposed simultaneously for a single violation, so a fine and a suspension could apply at the same time.
Continuing Violations: Daily Fines
One of the most financially significant provisions for expats to be aware of is Article 25, which allows enforcement committees to impose additional daily fines for each day a violation continues after a committee decision becomes final and unappealable. While the law caps the total fines, these accumulating daily charges can become substantial if compliance is delayed. The message is clear: rectify violations immediately once a decision is issued.
How Enforcement Committees Work
Violations are not handled directly by the TGA's operational staff alone. Article 24 establishes that dedicated committees are formed to:
- Hear and consider violations of the law, Regulations, and license terms
- Impose penalties within the scope of Article 22
- Issue formal decisions that can be appealed
These committees are formed by decision of the TGA President and follow defined procedures. Expats facing enforcement action have the right to appear before the committee. It is strongly recommended to seek legal representation when appearing before these committees, particularly if license revocation or significant fines are at stake.
Your Right to Appeal
The law's reference to decisions becoming unappealable implies that an appeals process exists. Expats should:
- Respond promptly to any violation notices — missing deadlines can forfeit appeal rights
- Document everything — keep records of your license, compliance steps, and any communications with the TGA
- Engage a qualified Saudi legal adviser early in the process to understand your rights and options
Liability for Property Damage
Beyond administrative penalties, Article 26 creates a separate civil liability framework. Service providers can be held responsible for damage to public or private property caused by their violations. This liability stands alongside — not instead of — any administrative penalties. For expats operating vehicle fleets or freight services, this underscores the importance of:
- Comprehensive commercial vehicle insurance
- Regular vehicle maintenance to prevent incidents
- Proper driver training and licensing
Impoundment and Auction of Vehicles
When a vehicle is impounded under the law, Article 27 sets a strict timeline. If the vehicle owner — or their designated representative or heirs — does not claim the vehicle within 90 days after the impoundment period expires, the TGA may sell the vehicle at public auction. Proceeds are first applied to:
- Outstanding fines
- Applicable fees
- Towing and storage charges
Any remaining balance is returned to the rightful owner. Expats should treat an impoundment notice as an urgent matter requiring immediate action.
Practical Steps to Avoid Penalties
- Understand the violation schedule — obtain a copy from the TGA or via a legal adviser
- Stay current on license renewals — operating with an expired license is a clear violation
- Train all drivers and staff on compliance requirements
- Respond immediately to any TGA correspondence or inspection findings
- Do not ignore impoundment notices — the 90-day clock moves quickly
- Seek legal advice early — the earlier you engage a lawyer, the more options you typically have
