The Difference Between Exempt and Zero-Rated Supplies
This distinction is one of the most misunderstood areas of Saudi VAT law, and getting it wrong can be costly.
- Zero-rated supplies: VAT applies at 0%. You still charge VAT (at zero), but you can reclaim any Input Tax you paid on costs related to making that supply.
- Exempt supplies: VAT does not apply at all. However, you cannot reclaim Input Tax on costs related to making exempt supplies. This can significantly affect your business if you make a mix of taxable and exempt supplies.
Under Article 31, if a supply qualifies as both exempt and zero-rated, the zero-rated treatment takes priority.
Key Exempt Supplies Under Saudi VAT Law
Financial Services (Article 20)
Most financial services are exempt from VAT. This includes:
- Lending and credit facilities
- Deposit-taking and account management
- Insurance and reinsurance services
- Foreign currency exchange
- Securities trading
Important exception: If the financial service is charged through an explicit fee, commission, or commercial discount, it is not exempt — it becomes a taxable supply subject to standard 15% VAT. This affects banks, brokers, and financial advisors who charge explicit service fees.
Residential Real Estate (Article 30)
The lease or license of residential real estate is exempt from VAT. This is highly relevant for expats:
- If you are renting a residential property in Saudi Arabia, no VAT should be charged on your rent
- If you own property and lease it as residential accommodation, those rental income streams are VAT-exempt
- Commercial real estate leases are not exempt — they are subject to standard VAT at 15%
- The transfer of ownership of both residential and non-residential real estate may follow different rules — always confirm with a tax advisor for property transactions
Key Zero-Rated Supplies Under Saudi VAT Law
Exports of Goods (Article 32)
If you are exporting goods from Saudi Arabia to a destination outside the GCC Council Territory, the supply is zero-rated, provided:
- You retain documentary evidence that the goods left the Council Territory
- The goods must be transported out within 90 days of the date of supply
- Without valid export evidence, ZATCA may reclassify the supply as standard-rated
Services to Non-GCC Residents (Article 33)
Under Article 33, a supply of services to a customer with no place of residence in any GCC Member State is zero-rated. This is particularly relevant for expat freelancers and consultants working with international clients.
Exceptions apply — the zero-rate does not apply in all cases, particularly where the services are physically performed in the Kingdom or relate to real estate in Saudi Arabia. Always verify whether the specific service qualifies before applying zero-rating.
International Transport Services (Article 34)
The following transportation services are zero-rated:
- International transport of goods — zero-rated under the Regulations
- International transport of passengers — zero-rated where the journey originates or terminates outside the Kingdom under qualifying conditions
- Supplies directly related to international transport — such as loading, unloading, and handling services connected to international shipments
Internal Supplies to Other GCC States (Article 19)
If your business supplies goods from Saudi Arabia to a person residing in another GCC Member State, you must retain evidence that the goods were actually transported to the destination state. Without this evidence, the supply may not qualify for the intended tax treatment.
Practical Tips for Expats
- Never assume a supply is exempt or zero-rated without checking the Regulations — mistakes can lead to underpaid VAT and penalties
- If you make mixed supplies (some taxable, some exempt), you will need to apportion your Input Tax — only the portion related to taxable supplies can be reclaimed
- Keep detailed records to prove zero-rating — export documentation, proof of customer residency, transport records
- If you provide financial services with explicit fees, these are taxable — factor VAT into your pricing
- Consult a Saudi-registered tax advisor if your business straddles multiple supply categories
